PD Breakfast: Employment Law Updates – Accommodation
We all know that employers have a duty to accommodate, but what does that mean in practice? What types of things do you have to accommodate – does it include things like childcare obligations or cannabis use? And how far do you have to go – what is “undue hardship” and what is a bona fide occupational requirement? Is an employee entitled to choose their form of accommodation, or can you substitute a less costly or onerous one?
We will discuss the underlying human rights basis for the duty to accommodate as well as how to respond to requests for accommodation so that you understand your rights and obligations and are well-equipped to handle those requests when you receive them.
