Tips For a Successful Mediation

In my latest Canadian HR Law blog post, I provided some tips on how parties should approach mediation. These are based on my experience as counsel and as a mediator. They include:

  1. Focus on the future, not the past
  2. Let reason, not emotion, rule
  3. Take time to assess your BATNA
  4. Don’t overestime the value of having your ‘day in court’
  5. Come with authority to settle, and with flexibility
  6. Take advantage of the opportunity to settle – but don’t feel pressured

I am the founder of Rudner Law and a Senior Employment Lawyer and Mediator. I am honoured to have been selected by my peers for inclusion in ‘The Best Lawyers in Canada’ in the area of Employment Law for the past six years, to have been repeatedly named in Canadian HR Reporter’s Employment Lawyers Directory (a comprehensive directory of the top employment law and immigration law practitioners in Canada), and to have been named one of Canada’s top Legal Social Media Influencers. More importantly, I am a proud father, husband, son and brother, as well as a passionate hockey fan.
